In the last decade, legal issues associated with needing to protect imperiled species and their habitats while at the same time ensuring that development goes forward without significant delays have been at the forefront of multiple projects and nationwide debates. For example, when a rare insect was discovered along the proposed pipeline route, the developer had to halt its activity and put in place a careful plan to safeguard against harm to that species while moving along the construction schedule. Nowadays, selecting suitable land to site and permit a solar farm, whether it is 3 or 300MW, involves hours of site studying, delineation, and coordination with state wildlife agencies to minimize impacts to protected species. Similarly, constructing an offshore wind turbine facility necessitates detailed and expensive studies and mitigation of impacts on protected right whales. Furthermore, federal regulators continue to believe that the magnitude of land-based wind farms that supply us with much needed renewable energy pose risks to endangered bats, migratory birds, and protected eagles. Our Species, Strategies & Solutions (S3) members face these legal issues as they operate their existing projects or prepare to expand their portfolios with new projects.
